I know the church does not send 1099's to landlords who have received rent payment from the church for welfare recipients. I am also sure the church is correct in not reporting these payments. However, I am looking for a legal or tax reference to support this position, since I am currently working for a not-for-profit who goes to great lengths to report similar payments. Can anybody provide a legal or tax reference supporting the church's position that might also benefit my employer?

I have no way of knowing, but I suspect that the Church probably has a Private Letter Ruling from the IRS to cover the situation. Under IRS rules in the United States, organizations or individuals are able to get a written ruling where the IRS looks at a specific situation and interprets and applies tax laws to that specific situation. The IRS provides a written ruling to the organization. A Private Letter Ruling cannot be relied upon by other taxpayers.
