BRANCH Clerk in Disciplinary Councils

We are a small branch on an American indian reservation that is part of a stake. We pull families from other wards in the stake to help support it. We have some confusion on whether the clerk should be included in BRANCH disciplinary councils. In Handbook 1, section 6.2.3 and 6.2.4 the clerk is not called out at even the ward level. When you get to 6.10.1 though the clerk is called out at the ward level, but not at the branch level. This has left the branch president unsure of whether the clerk is included, and left me out on the last one. However, after the council, LDS.org forwards the request to me to complete the paperwork. Because I wasn't in the council I couldn't complete it, and had to have the branch president sit with me and complete it. To me that would indicate that the system intends for the clerk to be present, else it would forward it to the Branch President to complete. Our obvious next step is to raise the question to the stake level, but was curious if others had run into this?

I'd say that based on 6.10.4, second paragraph, you would need to be in there. But it does seem at odds with 6.2.4 when contrasted with 6.2.3.

I'd suggest talking about this with the stake clerk who is responsible for your training. He can work to send it up higher.

The main paragraph causing confusion is 6.10.1 under the heading "Branch Disciplinary Councils in a Stake". But the additional paragraph you highlighted in 6.10.4 does seem to back what I'm saying on the need to be there in order to complete the report out.

You're right. It is 10.1. I got my sections mixed up. Under the ward heading, the clerk is specifically called out to be there. But is not mentioned under the branch.

I suspect where things are getting tipped up is that the clerk "attends" but does not "participate" (with is at odds with 10.1 under "ward").
