permission for baptism

We have a member that has "temporary" custody of his grand kids. He has had it for 7 years. One is getting baptized. Does he need written permission from the parents for this ordinance?

Who is going to sign the baptism and confirmation record as "parent or legal guardian"? This authorizes the Church to create and maintain a membership record.
