We have an eight year old that is getting baptized soon and would like to be baptized under his step-fathers last name, which is the name he goes by at school, but it hasn't been changed legally. Is there a way to do that without having to go through the court system and legal stuff?

Church records should reflect the member's legal name. If/when he legally changes his name, then the church records can be updated. He is allowed to carry his step-father's name as a "preferred name" in MLS.

The child can be baptized in the name by which he or she will be known. However the recording of the baptism in the membership record and on the baptism and confirmation certificate will be in the child's legal name (see CHI, Book 1, p 33).
