I belive that the cut off dates for 2009 Tithing Declaration is December 31s 2009. If a member mails in a donation which is postmarked on or before this date, how do we record this in MLS? Back Date a deposit?

You can record such donations in January 2010 (after you have closed out the 2009 financial year), creating a donation batch with a date of 31 Dec 2009. See the wiki article Year-end donations for details as to when this is allowed and how you need to handle it.
