LDSTech 2015 Gospel app contest Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. BY ENTERING, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE SPONSOR (DEFINED BELOW) FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

  1. Eligibility. The LDSTech 2015 Gospel App Contest (the "Contest") is open only to individuals who are at least the age of majority where they reside as of the time of entry. Employees of Sponsor or any organizations involved with the design, production, paid promotion, execution, or distribution of the Contest and any of their respective parents, subsidiaries, related and affiliated entities, agents, suppliers, the immediate family (spouse, parents, stepparents, siblings, stepsiblings, children, and stepchildren) and household members of all parties, any judge of the Contest and any other individual or organization whose participation in the Contest would create, in the sole discretion of Sponsor, a real or apparent conflict of interest are not eligible. The Contest is subject to all applicable laws and regulations. Void where prohibited. Individuals who are residents of, or Organizations domiciled in, a country, state, province or territory where the laws of the United States or applicable local law prohibits participating or receiving a prize in the Contest (including, but not limited to, Brazil, Quebec, Italy, and Cuba, Sudan, Iran, North Korea, Syria and any other country designated by the United States Treasury's Office of Foreign Assets Control) are not eligible to enter. Participation constitutes entrant's full and unconditional agreement to these official contest rules (the “Official Rules”) and Sponsor's decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

  2. Sponsor. Corporation of the Presiding Bishop of The Church of Jesus-Christ of Latter-day Saints, a Utah corporation sole, through its Information and Communication Services department (“Sponsor”), 50 East North Temple Street, Salt Lake City, Utah 84150.

  3. Contest Period. The submission period begins at 12:00:01 a.m. Mountain Time (“MT”) on September 8, 2015 and ends at 11:59:59 p.m. MT on September 18, 2015 (the “Contest Entry Period”). Winners will be selected from among the eligible submissions received during the Contest Entry Period.

  4. To Enter. No purchase necessary to enter or win. Individuals, teams of eligible individuals and organizations (including corporations, not-for-profit corporations and other nonprofit organizations, limited liability companies, partnerships, and other legal entities) that exist and have been organized or incorporated at the time of entry, and employ no more than 50 people (“Organizations”) may enter the Contest. Individuals, teams and Organizations may collectively be referred to as “Makers.” An individual may join more than one team or Organization and an individual who is part of a team or Organization may also enter the Contest on an individual basis. If a team or Organization is entering the Contest, they must appoint and authorize one individual (the “Representative”) to represent, act, and enter a Submission, on their behalf. The Representative must meet the eligibility requirements above. By entering a Submission on the Site on behalf of a team or Organization, you represent and warrant that you are the Representative authorized to act on behalf of your team or Organization. All Submission materials must be in English or, if not in English, the Maker must provide an English translation of the materials submitted.

To enter, go to http://tech.lds.org/blog/609 (the “Contest Website”) and register for the Contest by clicking the “Register Here” button and entering the required information, including your name email address, telephone number and location as well as a name and description of the app. Registration is not required to enter but provides Sponsor with information regarding the interest in the Contest. Then create a family-friendly software application, game or service related to the gospel or The Church of Jesus Christ of Latter-day Saints (the “Church”) that meets the requirements set forth below. During the Contest Entry Period return to the Contest Website, click on the “Submit” button and enter all of the required fields on the entry form, including certain information about you, the Representative (first and last name, email address, physical address (city, state, country, postal/zip code), telephone number, the age range and names of all other team members, if any). By completing a submitting an entry (each, a “Submission”) you represent that you have the right and permission to share the names of all team members with respect to each Submission.

Each Submission must provide a text description explaining the features and functionality of your Application (as defined below).No third party trademarks, copyrighted music, or other material may be used with respect to a Submission unless Maker has permission to do so.

Each Submission must include an Application meeting the requirements set forth in Section 5 of these Official Rules. The Maker must make the Application available free of charge and without any restriction, for testing, evaluation and use by Sponsor and Judges during the Contest and until the winners are announced. If the Application includes software that runs on proprietary or third party hardware that is not widely available to the public, including software running on devices or wearable technology other than smartphones, tablets, or desktop computers, the Sponsor and/or Administrator reserve the right, at their sole discretion, to require the Maker to provide physical access to the Application hardware upon request. The application must be made available using one of the following methods: Apple iOS App Store, Google Play Store, Windows Store; or for web/browser based submissions by providing a URL to the Application. For Apple iOS Applications, if the Application is not free, you must provide at least fifteen (15) promo codes to use for Judges during the judging process (promo codes are typically valid for only four (4) weeks, therefor do not obtain codes prior to September 8, 2015). For Android or Windows applications, if the Application is not free and is smaller than 25 mb, you must email the Application as an Android APK or Windows EXE attachment to This e-mail address is being protected from spambots. You need JavaScript enabled to view it along with your name and other identifying information to allow us to connect the Application to your Submission. If the Application is 25 mb or larger, you must place the Application in your Dropbox, OneDrive, or Google Drive account and provide a link to the location with your Submission.

Incomplete entries are void. Sponsor has the sole and absolute discretion to determine whether an entry is suitable or not. Entries must not be offensive, obscene, profane, lewd or defamatory as determined by Sponsor in its sole and absolute discretion. By entering a Submission you warrant that the Submission does not contain malicious code, such as viruses, timebombs, cancelbots, worms, Trojan horses or other potentially harmful programs or other material or information. Normal internet access and usage charges imposed by entrants’ online service will apply. No information regarding entries, other than as otherwise set forth in these Official Rules will be disclosed. You may make the Application available publicly via a website or online store, but you are not required to do so. You may submit more than one Submission, however, each Submission must be unique, as determined by the Sponsor, in its sole discretion. Applications may integrate SDKs, APIs and data, provided, you are authorized to use them. Personal information collected in connection with this Contest will be used only in connection with and for the purposes of administering this Contest. As a condition of entering the Contest, each entrant gives consent for Sponsor to obtain and deliver his or her name, address and other information to third parties for the purpose of administering this Contest and complying with all applicable laws, regulations and rules. All entries must be received by Sponsor by the deadlines or they will be void. Each entrant selected as a potential winner must comply with all terms and conditions set forth in these Official Rules and winning is contingent upon fulfilling all such requirements.

  1. Application Requirements.

    1. What to Create. Makers must create a working family-friendly software application related to the gospel or the Church (each, an “Application”). The Application should at least be a working prototype and may be either newly created by Maker, or created prior to the Contest Entry Period, but cannot have been publically released or marketed prior to October 10, 2014.

    2. Functionality. The Application must be capable of successfully installed and running consistently on the platform for which it is intended, and must function as expressed in the text description.

    3. Platforms. Each application must run on at least one of the following: Android device (such as a smartphone, tablet, etc.); iOS device (such as a smartphone, tablet, etc.); Windows Phone device (such as a smartphone, tablet, etc.); Windows desktop computer; Mac desktop computer.

  2. Judging. Eligible Submissions will be evaluated by students at BYU and BYU-Idaho involved in developing applications as well as by members of a local youth group (as potential users) chosen by Sponsor, in its sole discretion (collectively the “Judges”) and scored according to the following criteria:

    1. Social Application. Applications must enable a social or collaborative activity.

    2. Quality of Idea. Includes creativity and originality of the Application.

    3. Implementation of Idea. Includes how well the idea was executed by the Maker.

    4. Potential Impact. Will users get excited about the Application and does it solve a genuine problem. Preference will be given to solutions that apply across generations and include “the rising generation” (ages 13-30) in addition to older audiences. This may include gamification, games, community building, sharing or other relevant capabilities. “Likes” on facebook or similar indications of user interest may be factored into the decision.

The criteria above does not apply to the People’s Choice prize (as defined below), which will be determined by online voting by the LDSTech community from October 1, 2015 to October 8, 2015. Judges are not required to test the Application and may be chosen based solely on the text description provided as part of the Submission. The Submission that earns the highest overall scores based on the applicable criteria will become potential winners. If two or more Submissions are tied, the tied Submission with the highest score in the first applicable criterion listed above will be considered the higher scoring Submission. In the event any ties remain, this process will be repeated, as needed, by comparing the tied Submissions’ scores on the next applicable criterion. If two or more Submissions are tied on all applicable criteria, the panel of Judges will vote on the tied Submissions.

  1. Winner Selection. Judges will test and/or evaluate the Submissions based on the criteria listed in these Official Rules beginning September 21, 2015. Judges will select winners for all prizes other than the People’s Choice Award. Winners will be chosen in each of the following categories: Primary, Youth, Family and Other. Winners will be announced at the LDSTech Conference on October 15, 2015.

Voting for the People’s Choice Award winners will take place from October 1, 2015 through October 8, 2015. Voting will take place online by going to https://lds.qualtrics.com/jfe/form/SV_d05IINZ4rneDKNT and following the instructions to submit a ballot. Sponsor has the right to extend the judging and voting periods at any time for any reason. Verified vote counts will be determined by Sponsor. The Submission receiving the most verified votes during the voting period will become the potential winner of the People’s Choice Award. If there is a tie between two or more Submissions, the People’s Choice Award will be given to the Submission with the highest score from Judges. Voters will be limited to one vote per person. Makers may not directly or indirectly offer or pay any monetary or other form of consideration in exchange for a vote. You many not use any manual or automated vote process or methods to circumvent the one-vote limit. Doing so will subject all of your votes to disqualification. Sponsor may also disqualify a Maker, if the Maker receives multiple or irregular votes from the same user or users, receives votes in a manner that indicates manual, automated or other vote manipulation, or attempts to compensate voters. If the voting process fails to operate properly or appears to be tampered with or tainted with errors, fraud or unfair practices, Sponsor has the right to determine the People’s Choice winner by using non-suspect votes, or by any other means it deems appropriate. If no alternative means of determining the People’s Choice is available or selected, Sponsor may terminate the prize without designating a winner. Sponsor is not responsible for, and is not required to count any vote which, in its judgment, is incomplete, late, misdirected, damaged, unlawful or illicit. This includes votes secured in breach of the voting rules above, as well as those lost for technical reasons, or otherwise in violation these Official Rules.

Total Approximate Retail Value of all prizes awarded pursuant to this Contest is US $700. THE AWARD OF A PRIZE TO A POTENTIAL WINNER IS SUBJECT TO VERIFICATION OF THE IDENTITY, QUALIFICATIONS AND ROLE OF THE POTENTIAL WINNER IN THE CREATION OF THE SUBMISSION. The final decision to designate a winner shall be made by Sponsor. Potential winners will be notified using the email address associated with the Submission (the submitter is the “Representative” in the case of a team or Organization). In order to receive any prizes, the potential winner (including all participating team members in the case of a team or Organization) may be required to sign and return to Sponsor, affidavit(s) of eligibility (or a similar verification document) and liability/publicity release(s), and any applicable tax forms (“Required Forms”). Any Required Forms must be submitted within ten (10) business days after the Required Forms are sent. Sponsor may deem a potential winner ineligible if: the prize or prize notification is returned as undeliverable; the Submission is disqualified or ineligible for any reason; or the potential winner’s Representative or any participating member does not respond to multiple emails or fails to sign and return the Required Forms by the applicable deadlines, or responds and rejects a prize. In the event a potential winner is disqualified or found to be ineligible, Sponsor may award the applicable prize an alternate potential winner.

Within forty-five (45) days after announcement of the winners at the LDSTech Conference or, if Sponsor requires any Required Forms, after return of such Required Forms, prizes will be mailed to the winning Maker’s address (if an individual) or the Representative’s address (if a team or Organization). If a winner is in attendance at the LDSTech Conference, prizes may be given directly to such winners, provided any Required Forms are completed and returned to Sponsor at that time. It will be the responsibility of the winning Maker’s Representative to allocate the prize among their team or Organization’s participating members, as the Representative deems appropriate. Sponsor has the right to make a prize substitution of equivalent or greater value. Sponsor will not award a prize if there are no eligible Submissions entered in the Contest, or if there are no eligible Submissions for a specific prize. Winners (and in the case of team or Organization, all participating members) are responsible for reporting and paying any/all applicable taxes related to any prize, including, without limitation, any/all applicable taxes in their jurisdiction of residence (federal, state/provincial/territorial and local). Winners may be required to provide certain information to facilitate receipt of the award, including completing and submitting any tax or other forms necessary for compliance with applicable withholding and reporting requirements. For prizes valued at US $600 or more, if any, United States residents are required to provide a completed form W-9 and residents of other countries are required to provide a completed W-8BEN form. Winners are also responsible for complying with all applicable foreign exchange and banking regulations in their respective jurisdictions and reporting the receipt of the prize to relevant government departments/agencies, if necessary. Sponsor, and/or Prize provider, reserve the right to withhold a portion of the prize amount to comply with the tax laws of the United States or other Sponsor jurisdiction, or those of a winner’s jurisdiction.

  1. Intellectual Property Rights and Use. Your Submission must: (a) be your (or your team or Organization’s) original work product; (b) be solely owned by you, your team, or your Organization with no other person or entity having any right or interest in it; and (c) not violate the intellectual property rights or other rights including but not limited to copyright, trademark, patent, contract, and/or privacy rights, of any other person or entity. A Maker may contract with a third party for technical assistance to create the Submission provided the Submission components are solely the Maker’s work product and the result of the Maker’s ideas and creativity, and the Maker owns all rights to them. A Maker may enter a Submission that includes the use of open source software or hardware, provided the Maker complies with applicable open source licenses and, as part of the Submission, creates software that enhances and builds upon the features and functionality included in the underlying open source product. By entering the Contest you represent, warrant, and agree that your Submission meets these requirements. An Application must not have been developed, or derived from an Application developed, with financial or preferential support from Sponsor. Such Applications include, but are not limited to, those that received funding or investment for their development, were developed under contract, or received a commercial license, from Sponsor any time prior to the end of Contest Entry Period. Sponsor, at its sole discretion, may disqualify an Application, if awarding a prize to the Application would create a real or apparent conflict of interest.

By entering the Contest, you grant to the Sponsor, and any other third parties acting on Sponsor’s behalf, a royalty-free, non-exclusive, worldwide perpetual license to display publicly and use for promotional purposes the Submission, in perpetuity. This license includes, but is not limited to, posting or linking to the Submission on Sponsor’s, and partners’ websites and applications, including the Contest Website, and display and promotion of the Submission in any other media, worldwide. Subject to the licenses described in these Official Rules, any applicable intellectual property rights to a Submission will remain with the Maker. The following Submission components must be displayed to the public: name of the Application, the platform upon which the Application is built and a link to download the Application (e.g. App Store, Google Play) or a downloadable APK file. Other Submission materials may be viewed by Sponsor and Judges for screening and evaluation. Makers represent and warrant that Sponsor is free to use Makers’ Submission in the manner described above, as provided or as modified by Sponsor, without obtaining permission or license from any third party and without any compensation to Makers.

  1. Publicity. By participating in the Contest you consent to the use of personal information about you, if you are a winner, by Sponsor and any third party acting on its behalf. Such personal information includes, but is not limited to, your name, likeness, photograph, voice, opinions, comments and hometown and country of residence. It may be used in any existing or newly created media, worldwide without further payment or consideration or right of review, unless prohibited by law. Authorized use includes advertising and promotional purposes. The duration of your consent is for a period of three years following the conclusion of the Contest. This consent applies, as applicable, to all members a Maker’s team or Organization that participated in the winning Submission.

  2. Conditions and Release. By entering the Contest, you (and, if you are entering on behalf of a team or Organization, each participating members) agree(s) to the following: (a) the relationship between you, the Maker, and Sponsor, is not a confidential, fiduciary, or other special relationship; (b) you will be bound by and comply with these Official Rules and the decisions of Sponsor and/or the Judges which are binding and final in all matters relating to the Contest; and (c) you acknowledge and agree that (i) the personally identifiable information provided by you will be used for administering the Contest and communicating with you regarding the Submission and to seek your feedback during and after the Contest; (ii) Sponsor and any respective parents, subsidiaries, and affiliated companies may collect the internet protocol addresses through which your Submission is transmitted; and (iii) Sponsor may transfer your personal information to its affiliated entities located in other countries.

You release, indemnify, defend and hold harmless Sponsor, and any respective parents, subsidiaries, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and all of their respective past and present officers, directors, employees, agents and representatives (hereafter the “Released Parties”) from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees), including but not limited to negligence and damages of any kind to persons and property, breach or violation of any representation, defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a Maker’s entry, creation of Submission or entry of a Submission, participation in the Contest, acceptance or use or misuse of the prize (including any travel or activity related thereto) and/or the broadcast, transmission, performance, exploitation or use of the Submission as authorized or licensed by these Official Rules.

Without limiting the foregoing, the Released Parties shall have no liability in connection with: any incorrect or inaccurate information, whether caused by Sponsor’s electronic or printing error, or by any of the equipment or programming associated with or utilized in the Contest; any unauthorized submission of personal information by you; technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, internet connectivity or electronic transmission errors, or network hardware or software or failure of the Contest Website; unauthorized human intervention in any part of the entry process or the Contest; technical or human error which may occur in the administration of the Contest or the processing of Submissions; or any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the Maker’s participation in the Contest or receipt or use or misuse of any prize. The Released Parties are not responsible for incomplete, late, misdirected, damaged, lost, illegible, or incomprehensible Submissions or for address or email address changes of the Makers. Proof of sending or submitting will not be deemed to be proof of receipt by Sponsor.

If for any reason any Maker’s Submission is determined to have not been received or been erroneously deleted, lost, or otherwise destroyed or corrupted, the Maker’s sole remedy is to request the opportunity to resubmit its Submission. Such request must be made promptly after the Maker knows or should have known there was a problem, and will be determined at the sole discretion of the Sponsor.

  1. Limitation of Liability. By entering, all Makers (including, in the case of a team or Organization, all participating members) agree to be bound by the Official Rules and hereby release the Released Parties from any and all liability in connection with the Prizes or Maker’s participation in the CONTEST. Provided, however, that any liability limitation regarding gross negligence or intentional acts, or events of death or body injury shall not be applicable in jurisdictions where such limitation is not legal.

  2. Disputes. Makers agree that, to the fullest extent permitted by law any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than those concerning the administration of the Contest or the determination of winners, shall be resolved individually, without resort to any form of class action; any and all disputes, claims and causes of action arising out of or connected with this Contest or any prizes awarded, shall be resolved exclusively by the United States District Court of Utah or the appropriate Utah State Court and Makers consent to the exclusive jurisdiction and venue of such courts; and under no circumstances will Makers be entitled to, and Makers hereby waives all rights to claim, any punitive, incidental and consequential damages and any and all rights to have damages multiplied or otherwise increased.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Makers and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Utah, without giving effect to any choice of law or conflict of law rules (whether of the State of Utah or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Utah.

  1. General Conditions. Sponsor reserves the right, in their sole discretion, to cancel, suspend and/or modify the Contest, or any part of it, in the event of a technical failure, fraud, or any other factor or event that was not anticipated or is not within their control. Sponsor reserves the right in its sole discretion to disqualify any individual or Maker they find to be actually or presenting the appearance of tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in a manner that is inappropriate, unsportsmanlike, not in the best interests of this Contest, or a violation of any applicable law or regulation. Any attempt by any person to undermine the proper conduct of the Contest may be a violation of criminal and civil law. Should Sponsor suspect that such an attempt has been made or is threatened, they reserve the right to take appropriate action including but not limited to requiring a Maker to cooperate with an investigation and referral to criminal and civil law enforcement authorities.

If there is any discrepancy or inconsistency between the terms and conditions of the Official Rules and disclosures or other statements contained in any Contest materials, including but not limited to the entry form, Contest Website, advertising (including but not limited to television, print, radio or online ads), the terms and conditions of the Official Rules shall prevail. The terms and conditions of the Official Rules are subject to change at any time, including the rights or obligations of the Maker and Sponsor. In the event of any such change, Sponsor will post the terms and conditions of the amended Official Rules on the Contest Website. To the fullest extent permitted by law, any amendment will become effective at the time specified in the posting of the amended Official Rules or, if no time is specified, the time of posting. If at any time prior to the deadline, a Maker or prospective Maker believes that any Official Rule is or may be unclear or ambiguous, they must submit a written request for clarification.

Sponsors failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Should any provision of these Official Rules be or become illegal or unenforceable in any jurisdiction whose laws or regulations may apply to a Maker, such illegality or unenforceability shall leave the remainder of these Official Rules, including the Rule affected, to the fullest extent permitted by law, unaffected and valid. The illegal or unenforceable provision shall be replaced by a valid and enforceable provision that comes closest and best reflects Sponsor’s intention in a legal and enforceable manner with respect to the invalid or unenforceable provision.

Excluding Submissions, all intellectual property related to this Contest, including but not limited to copyrighted material, trademarks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned or used under license by Sponsor. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owners is strictly prohibited. Any use in a Submission of Sponsor intellectual property shall be solely to the extent provided for in these Official Rules.

  1. Additional Terms. Please review the lds.org “Rights and Use Information” (available at https://www.lds.org/legal/terms) that apply to your use of the Contest Website and participation in the Contest. These terms are incorporated by reference into these Official Rules. If there is a conflict between the Terms of Service and these Official Rules, the latter terms shall control with respect to this Contest only.

Sponsor collects personal information from you when you enter the Contest. The information collected is subject to the “Privacy Policy” (available at https://www.lds.org/legal/privacy). Sponsor will use technical and security measures to protect any personal information against loss, misuse, and unauthorized access or disclosure.
